These Terms of Service (“Terms”) are an agreement between you and Plant Magic Collective (“Plant Magic,” “we,” “us,” or “our”), located at 925 E 17th Ave, Denver, CO 80218. They govern your access to and use of our website, event registrations, online store, memberships, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Eligibility and accounts
You must be at least 18 years old to create an account, register for events, or make purchases. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.
2. Events and registration
When you register for an event, you agree to provide accurate information and to pay any applicable fees at checkout. Registration is confirmed once payment is completed (or, for free events, once you complete the registration flow). Spaces may be limited and are allocated on a first-come, first-served basis.
Refunds for event registrations are governed by our Refund Policy, which is incorporated into these Terms by reference. In summary, refunds are available up to 48 hours before an event’s start time, and registrations are non-refundable within that window. If we cancel an event, you will receive a full refund.
Some events require you to review and sign a waiver or other acknowledgment before participating. Your participation is conditioned on completing any required forms.
3. Assumption of risk
Our events and programs may involve physical, emotional, and experiential activities. You participate voluntarily and assume the inherent risks of participation. You agree to follow all instructions and safety guidance provided by facilitators and staff, and to disclose any health conditions where requested. Nothing offered through the Services is medical, legal, or professional advice, and our offerings are not a substitute for professional care.
4. Store purchases
Products available through the Plant Magic Apothecary are subject to availability and to the descriptions and pricing shown at the time of purchase. We strive for accuracy but do not warrant that product descriptions or other content are error-free. Returns, refunds, and shipping for store orders are handled separately from event refunds; contact tech@plantmagic.org with store questions.
5. Memberships and subscriptions
Memberships and other recurring subscriptions renew automatically until cancelled. You may cancel at any time from your account dashboard; cancellation stops future renewals and takes effect at the end of your current billing period. Amounts already billed are generally non-refundable except as required by law.
6. Payments
Payments are processed by third-party payment providers (including PayPal). By submitting a payment, you authorize us and our payment providers to charge your selected payment method for the total amount shown at checkout, including any applicable taxes. We do not store full payment card numbers on our systems.
7. Coupons and discounts
Promotional codes and discounts are subject to their stated terms, including expiration dates and usage limits. They have no cash value, cannot be combined unless stated, and may be modified or revoked if we suspect fraud or abuse.
8. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms;
- Interfere with or disrupt the Services or their security;
- Attempt to gain unauthorized access to any system or account;
- Misrepresent your identity or affiliation; or
- Harass, harm, or disrupt other participants, facilitators, or staff.
9. Intellectual property
The content on our website — including text, graphics, logos, and course or event materials — is owned by or licensed to Plant Magic and is protected by intellectual property laws. You may not copy, reproduce, or distribute it without our permission, except as allowed by these Terms or applicable law.
10. Third-party services and links
The Services rely on and may link to third-party providers (such as payment, email, and scheduling services). We are not responsible for the content, policies, or practices of third parties. Your use of third-party services may be subject to their own terms.
11. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, secure, or error-free.
12. Limitation of liability
To the fullest extent permitted by law, Plant Magic and its officers, directors, employees, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to us for the specific event or product giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless Plant Magic from any claims, losses, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Services.
14. Governing law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Denver, Colorado, except where otherwise required by applicable law.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
